Billy’s Websites | My General Terms of Service - Your website will be registered in your name and address and you will be the registered owner of the domain name for your website. - You agree that all the information, images and logos used on your website are correct for your business and that I can change any content if requested to do so by third parties who advise me that they own the content, images or videos on your website. - I reserve the right to change images, logos and information where I am advised they are in breach of copyright. I primarily use images and information provided by you in the website design and you take full responsibility for all the images and content used in the website, social networks or wherever such information may appear (online and offline) in relation to your website. - You agree that you have looked over the final live website (and any future changes and updates we make to your website) and agree with the above and that your website (including future changes) are designed in good faith and I hold no responsibility for any loss to you or third-parties (legal, financial or otherwise) in relation to any of the information, coding, images, logos, any other content/ design process, third-party code or services used in the design/ hosting of your website, but I can make changes if requested by you, relevant third parties or on my own to your website. - Like most web design businesses, I use a range of third-party programs, services and hosting and while very rare, sometimes something may occur at one of our third-party suppliers which may result in the website needing to be changed or updated or taken offline for a limited time. I will work with these third-parties to resolve any issues but I cannot be held liable for any loss to you due to third-party actions but will actively work to resolve any issue which may occur. - You also agree that you have checked that the features work (e.g. email etc.) and I hold no liability for any loss (to you or third-parties), including malware/ third-party viruses etc., but I will work with you to resolve any issues which may occur. I will help to resolve issues relating to your online presence but cannot be held liable for any unforeseen effects relating to your new website. Whatever effects may become apparent in relation to your new website, MB Business Services t/a BillysWebsites.ie cannot be held liable for any loss, financial, legal or otherwise and you agree that you use my services at your own risk and you accept full responsibility for your new website, financial, legal or otherwise but I will work proactively to advise or resolve any issue(s) you may have once I am advised of an issue you may have. You understand that all and any advice or work we offer is provided/ undertaken by me for you entirely at your own risk and MB Business Services t/a BillysWebsites.ie cannot be held liable for any issues or any loss, financial, legal or otherwise that may arise for any such advice given or work I undertake on your behalf. - Web design includes design of the number of pages as specified in the website package you choose. The website is designed to work on the current popular smartphones, tablets and laptops as at the time you first engaged our services. A fee may be required to upgrade your website in the future if additional work is required to comply with future newer operating systems, browsers etc. or you may be required to upgrade to my latest version of our website packages. - My annual renewal fee covers domain name renewal for one year, hosting for one year, changes to text, photos and images on your website for one year (subject to fair use) and SSL certificate for one year if it’s included in your website package. - If third-party programs require updating, there may be a fee to cover the upgrade cost and cost of upgrading to new programs. - If third-party programs used in your website require a fee to upgrade to a newer version, a fee may be charged to cover the cost of upgrading to new third-party programs etc. If the annual cost of registering your domain name, hosting your website or any other external costs associated with your website increases, there will be an increase in the annual renewal charge. - Your website will remain at the version when you first engaged my services until you upgrade to my latest version. Any additional costs required to allow your website to comply with future changes to operating systems, browsers etc. will be met by the client to ensure that the website continues to work as expected. - You agree that the email and phone number on the website are correct and to test them to ensure they send emails/ call your business phone number and you agree to test the third-party ecommerce facilities, contact form(s) etc. and that they work as expected. e.g. payment received and payer is directed to payment thank you page and emails received etc. You are responsible for setting up and managing any payment systems (due to EU regulations) and I will only provide a link to your payment system provider checkout page. You agree to advise me in a reasonable timeframe if any issues occur so I may look into them. - Please be aware that as I manage the back-end of your website, I and my 3rd party suppliers may have access to all data in relation to your website and emails etc. sent to and by you in relation to your website and you allow us the right to access them to manage your website to improve SEO and to allow us to manage your website e.g. SEO etc. I may also have access to your social networks, directories and other platforms that you/I use to manage your website for SEO purposes etc. and you fully understand that I may have access and can access, manage and make changes to all such third-party websites, directories, platforms etc. at any time. The client understands that we have access and any updates, changes etc. we make to such third-party services are made in good faith and MB Business Services t/a BillysWebsites.ie cannot be held liable for any loss, financial, legal or otherwise from any and all such actions we may take. - Free hosting in year one is subject to a fair use policy but this will have minimum effect for the vast majority of users. Free domain name is in year one. Free SEO is in year one only. Tablet friendlyrefers to the regular iPad and similar tablets on the market. Mobile website refers to regular iPhone and similar devices on the market. - My Website Management Service covers free updates to photos and information text on your website in year one and is subject to a fair use policy. If you wish to add additional services or make a substantial change to your website, I charge a reasonable fee which will be decided by the work to be done to change the website to accommodate the extra pages. The current charge for each extra service (inclusive of extra webpage) added to your existing website package can be viewed on my website or contact me for a quote on any bespoke additions or changes to your website. - My tailored SEO is an excellent service for improving the chances of your new website being found on the google search engine. Google search is a third-party company and while our SEO service has a proven and excellent record, I cannot be held liable for search results. You must also follow my instructions in relation to our SEO service e.g. providing me with your google pin number so I can add it to your website to ensure google search knows you are a legitimate business for search purposes etc. - Your business details, phone number, address etc. will be made publicly available on the internet to improve the effectiveness of SEO e.g. on social networks & any other places/ directories we advertise your business. I can access, update and change these at any time. If you do not wish for such details to be made public, this may impact on the SEO. However, such details may become public in any event and I therefore cannot guarantee that such details remain private. - My free SEO service applies to year one only and applies to my SEO strategy that I use at the date you first engage my services. - Your website will be designed with SEO in mind. If you request any change to your sample or live website or upgrade to a newer website package, your SEO may be negatively impacted. You understand that any changes you request, including changing or increasing your service area outside the areas I recommend, will adversely impact on your website’s SEO. If yourself or you use a third-party to make any changes to the website including SEO, which includes changes to social networks, using Google Ads or anywhere else online that may impact upon your website’s SEO etc., you agree to inform me in advance and I am not responsible for any unforeseen events or legal issues which may occur if you use a third-party in relation to any aspect of your website including my advice in relation to third-party hosting etc. - If Google or other search engines change their search algorithm at a future date, a fee may be required to update your website to ensure that Google etc. still finds your website. My free SEO package applies to year one only and applies to my SEO strategy we use as at the date you first engage my services. - In order to comply with GDPR, I will not add Google Analytics, Facebook pixels or any other tracking code, scripts or programs to your website. Please note that if you request me to add a script for Google Ads, Facebook Pixel or other third-party scripts, I may refuse to add it as this may slow your website and therefore impact upon your Google PageSpeed Rating etc., which may then impact upon your organic SEO results. - Please note that all third-party scripts used on the website e.g. facebook, contact forms, sliding images etc. will remain at the version added as at the date you first engaged my services, unless you upgrade to my most recent website package version. - You will be solely responsible for complying with all laws and legislation in relation to your website including data collection e.g. emails and you agree to comply with all laws & legislation applicable in your country & in other countries you operate in. If you use third-party services e.g. facebook, twitter, Google Ads etc., you agree you will be responsible for complying with all laws and legislation in relation to your use of such services in Ireland, the UK, the EU and Worldwide. If you believe I should update your website to comply with any existing or new legislation in your country, you agree to inform me and I will work with you to see if I can make your website compliant. If any such changes require significant work, there may be a charge to make the changes or I may refuse to implement such a change and any fees already paid are non-refundable. All and any advice given or work undertaken or changes made in relation to both your website and third party service providers by MB Business Services is provided in good faith and I cannot be held responsible or be held liable for any loss, financial, legal or otherwise to either you or third-parties for any work undertaken or advice I provide which is offered on a good faith basis. - You agree to never use the passwords used to access any online services associated with your website at the set-up stage on any other online services as this may compromise the security of your website and negatively affect your website SEO. If you lose or change any of your password(s) associated with your website or deny me access, I will no longer be able to manage your SEO or website & you understand this will negatively affect both your SEO & website. Iem> not liable or responsible for your website if it is hosted on 3rd party providers and a fee for all changes, updates etc. after year one will apply. - All correspondence & payments made in relation to your services with me are made entirely at your own risk & I am not liable for any financial, legal or other losses. - MB Business Services is not responsible (legal, financial or other losses) for third-party programs e.g. email, payments etc. used either on client websites or on this website and this website and all third-party programs and any service you use in dealing with me are used at your own risk. - If you use my services to help you advertise on facebook or google adwords or any other advertising services, I am not responsible for unforeseen costs/issues which may arise and my services are offered on a good faith basis and I cannot be held responsible for any loss or costs (to you or third parties) associated with any advertising campaign which you carry out with my help in setting-up/ using the campaign or in relation to any advice we provide. I do not add third-party scripts to your website in order to track their effectiveness. This is because I primarily deal with self-employed people who operate in their local area and I don't believe that such tracking has a benefit to my clients. - If the client undertakes any activities or actions which damages or may damage the reputation of the service provider, I can cancel the service at any time. Any fees already paid are non-refundable and I will help you transfer to another service provider. - I may use my existing client websites in advertising as examples of the service I provide for marketing my services. - If there is more than one person involved in your business, you must provide only one contact with whom I will deal with. This is very important to ensure there is no mis-communication and I will not engage with any other party outside the person who requested the website service. - You agree to inform me in a timely manner of any concerns you may have or issues that are brought to your attention in relation to your website so that I can look into any issues that may occur and help with resolving them. You also agree to never use your google password set-up specifically for your website for any other online service without informing me. - If you sell your business or website domain name to a third-party, my service agreement is with the original owner who paid for the website and my management service is not transferable to third-parties and my service may be ceased. However, you will still be the owner of the domain name and I will help you transfer your domain name to another service provider. - If you wish to change service providers at a future date, I will work with you and your new service provider to transfer the domain name to your new service provider for free. However, the website design (incl. content), code and third-party services used in the website cannot be transferred over i.e. just the domain name is transferred to your new service provider. For security reasons, the content, code and third-party services will be deleted once a request for the code to transfer the domain name has been made and I cannot grant access to you or third-parties to my hosting platform & fees already paid are non-refundable. - The client understands and agrees that I operate on a good faith basis and the client will take full responsibility for their website. Any work I undertake, including advice provided, http to https migration etc., is completed in good faith and the client understands that website design, the internet, website standards, browser standards, legislation etc. are complicated, interpretation of both website design and implementation is subjective and constantly changing and that I cannot accept liability (legal, financial or otherwise) to you or third-parties for any events in relation to any work I undertake, including, but not limited to, on your website, advice provided, work provided on third-party services (e.g. facebook etc.), in relation to any future website updates or updates on third-party websites I undertake for you. - If the annual renewal payment is not made by the due date, I reserve the right to end my service with the client as at that date or at any time after that date until the payment is paid. If you purchase your domain name or host your website yourself with another third-party hosting provider, I am not responsible for monitoring your hosting or advising you when the annual renewal is due on either your domain name or hosting. If you wish for me to continue managing your website after year one, you must advise me and pay an annual renewal management fee or a fee will be charged for work carried out after that date. - If you wish to upgrade to the latest version of my website packages, please advise me and there may be discounts available. My free samples and any other offers, deals, website packages and any work I undertake for you etc. are offered at my discretion and can be withdrawn at any time. - During the .ie or .uk domain registration process I may be required to collect personal ID from you such as your Passport, Drivers License, PPS number, CSO/RBN number or Revenue documentation to prove your eligibility to own the domain name. - If I change our business name, domain name or sell our business to a third-party at a future date, you agree that I can transfer your website, contact information details, log-in details etc. to such third-parties and that your terms and conditions may change at the time of such a transfer taking place. - As I am a managed website service, I do not provide log-in details to your website. If you wish to make changes to your website (text and photos), you can email or call me and I will make the changes for you. Many other website service providers design websites in e.g. Wordpress, which provide you with the ability to edit your website yourself and if you believe you would be comfortable managing and making edits to your website yourself, I will help with the transfer to a new website service provider. - Websites from existing clients may transfer to MB Business Services t/a BillysWebsites .ie. MB Business Services may continue to manage old websites and you will be billed & managed through MB Business Services t/a BillysWebsites.ie. This will include existing domain name & hosting renewal & requested changes to existing information and images. - Please also note that as I no longer offer certain website packages any offers associated with these older website packages can no longer be claimed. Please contact me to check if an upgrade to my newer website packages would benefit you or if you wish to change service providers I will help with the transfer process for free. If you have any queries, please contact me. - All services provided on BillysWebsites.ie, are carried out by MB Business Services. By using my services you are deemed to have agreed to all the terms and conditions and terms of service on this page and any future terms of service or information posted here or on other pages on this website in relation to the range of services we carry out on your website and related third-party services and that your service agreement is solely with MB Business Services.
